Courts Effectively Restore BOC’s DMEPOS Accrediting Organization Status

On January 9, 2026, the United States District Court, District of Maryland, granted the Board for Certification/Accreditation’s (BOC) request for a temporary restraining order (TRO) against the Centers for Medicare & Medicaid Services (CMS) for their December 2, 2025, termination of BOC’s Accrediting Organization (AO) approval.

BOC Status Reinstated

Effective January 9, 2026, the temporary restraining order allows the Board of Certification/Accreditation:

  • To continue operations.
  • Provide full accreditation- and reaccreditation-related services in 46 states.
  • Accept new DMEPOS applications in 46 states.
  • Continue to certify DMEPOS individuals.

Accreditation Exceptions – California, Florida, New York, Texas

Restrictions announced in May 2025 remain in force for reaccreditation and new accreditation of all DMEPOS suppliers in:

  • California
  • Florida
  • New York
  • Texas

For businesses located in these states, current Board of Certification/Accreditation accreditations remain valid. However, new accreditation applications and renewals must be sought through an alternate CMS-approved Accrediting Organization.

Certifications Remain Valid
